Terms of Service
Trial run: PVQuick is currently in a trial run.
These Terms of Service (the “Terms”) govern your use of PVQuick, the web-based photovoltaic (PV) system design software at pvquick.ai and the website pvquick.com (together, the “Service”), provided by PVQuick LLC, 455 Market St Ste 1940 #671818, San Francisco, CA 94105, USA (“PVQuick”, “we”, “us”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it.
1. The Service
PVQuick helps users prepare the preliminary design and feasibility study of PV projects: solar resources, array design and land use, irradiation and shading, energy yield, economics, greenhouse-gas reduction and a report. The Service is offered as a first version and is being developed further; we may add, change or remove features.
2. Accounts
- You must provide accurate information when you register and keep it up to date.
- You are responsible for keeping your password secure and for all activity under your account. Tell us at once at support@pvquick.com if you suspect unauthorized use.
- You must be at least 18 years old, or the age of legal majority where you live, to create an account.
3. Plans and payment
- Free plan: up to 2 projects, at no charge; more can be opened with AI Hub points (see the AI Hub Guidelines).
- Pro plan: USD 20 per month, billed monthly in advance through our payment processor, Stripe. The subscription renews automatically each month until you cancel.
- You can cancel at any time on the Billing page. Pro stays active until the end of the current billing period, then your account returns to the Free plan. Projects beyond the Free limit remain stored but may not be opened on the Free plan.
- Fees already paid are not refundable, except where the law requires a refund.
- We may change prices with at least 30 days’ notice; a new price applies from your next billing period. Prices do not include taxes, which may be added where required.
4. Nature of the results
The Service produces estimates for preliminary design and feasibility purposes. Results depend on models, recommended default values, equipment data and third-party weather and map data, and on the inputs you provide. They are not a detailed engineering design, a site survey, a certified energy-yield assessment or financial, legal or investment advice. You are responsible for checking the results and for having them reviewed by qualified professionals before relying on them for construction, financing, procurement or other decisions.
5. Your content
You keep all rights to the project data and files you enter or upload (“Your Content”). You grant us a limited license to store, process and display Your Content only as needed to provide and secure the Service. You are responsible for having the right to use Your Content.
6. Our intellectual property
The Service, including the software, calculation models and methods, equipment and inverter-unit libraries, documents, reports formats, designs and the PVQuick name and logo, belongs to PVQuick LLC and its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your own projects. You may not, and may not help others to:
- copy, modify, decompile, disassemble or reverse engineer the Service or attempt to derive its models, algorithms or source code;
- use bots, scrapers or other automated means to access the Service or to extract its data, libraries or results in bulk;
- resell, rent or sublicense the Service, or use it to build a competing product or service;
- circumvent plan limits, security or access controls.
7. Acceptable use
You may not use the Service for any unlawful purpose, to infringe others’ rights, to upload malicious code, or in a way that disrupts or overloads the Service or our infrastructure.
8. Third-party services and data
The Service relies on third-party providers and public data sources, such as Amazon Web Services for hosting, Stripe for payments, map tiles from Esri, weather and solar data from NASA POWER, Global Solar Atlas, PVGIS and the National Solar Radiation Database, and terrain, water and land-cover data from Copernicus DEM, ESA WorldCover, JRC Global Surface Water and OpenStreetMap. Their availability and accuracy are outside our control, and their own terms may apply. The attributions and licences of these data, and of the third-party photographs in reports, are listed on our Data Sources and Licences page; those photographs are provided under their own licences. The organisations in charge of the Copernicus programme by law or by delegation do not incur any liability for any use of the Copernicus WorldDEM-30.
9. Disclaimer
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, PVQuick will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or USD 100 if you paid nothing.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate accounts that breach these Terms or create a security or legal risk. If we discontinue the Service, we will give reasonable notice so that you can export Your Content.
12. Changes to these Terms
We may update these Terms. For material changes we will give notice on the website or by email before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in San Francisco, California, unless mandatory law where you live provides otherwise.
14. Language
These Terms are provided in English and Chinese. If the two versions differ, the English version prevails.
